STANDARD TERMS AND CONDITIONS FOR THE TAKE N PAY PROMOTIONAL COMPETITION CONDUCTED BY TAKE N PAY FOOD TOWN HYPER
(hereinafter referred to as the “Promoter”)
1. Definitions
1.1 PARTICIPANT means a person who enters, competes in or is otherwise eligible to win a promotional competition.
1.2 PERSONAL INFORMATION means information relating to an identifiable, living, natural person and where applicable, an identifiable, existing juristic person including but not limited to defined in the Protection of Personal Information Act 4 of 2013 (“POPIA”).
1.3 PRIZE includes a reward, gift, free good or services, price reduction or concession, enhancement of quality or quality of goods or services, or other discounted or free thing.
1.4 PROMOTER means Umzah Trading T/A Take N Pay Food Town Hyper (Pty) Ltd, registration no.: 2004/09149/23, a private company duly incorporated in terms of the Company’s Law of the Republic.
1.5 PROMOTIONAL COMPETITION means any competition, game, scheme, arrangement, system, plan, or device for distributing prizes by lot or chance.
2. Competition
2.1. This Promotional Competition commences on [] (subject to change).
2.2. To enter this Promotional Competition, you must:
2.2.1. Purchase at TAKE N PAY FOOD TOWN HYPER for any 3 x 2lt Liqui Fruit or any 2 sparkling Liqui fruit products amount to qualify.
2.3. To qualify as an entrant into this Promotional Competition, you must:
2.3.1. Purchase at TAKE N PAY FOOD TOWN HYPER
2.3.2. Reside within South Africa;
2.3.3. Must be 18 years of age or older;
2.3.4. Enter this Promotional Competition as an individual and not as a juristic entity.
2.4. Entrants may enter the competition as many times as they wish provided that each entry is associated with a separate qualifying purchase. Each completed qualifying purchase, or transaction shall result in one (1) automatic entry. The entrant will only be eligible for one prize.
3. Prize
3.1. Entrants stand a chance to win [prizes to the value up to R350 000].
3.2. The final draw will be held on [5 April 2025 subject to change
3.3. The prize winner will be notified telephonically with the details they supplied on the entry form.
3.4. The prize/s are not transferable, nor can they be exchanged for cash or any other prize other than the prize offered above.
4. Selection of Winners
4.1. Finalists/ Winners will be selected within December to March of this Promotional Competition closure date. This date is subject to change without notice.
4.2. Finalists will enter Phase 2 which includes (Lock and Load phase) With 50 finalists
4.3. Entrants to whom Prizes will be awarded will be selected through a random draw conducted by the promoter
4.4. Winners will be contacted telephonically on the number they used to enter online. A winner who has no valid contact details will be excluded from the draw.
4.5. The Promoter reserves the right to disqualify a winner if he/she does not answer the telephone call on the Promoter’s first attempt to contact them and verify the winner’s identity. The Promoter reserves the right to hold another random draw and allocate the prize to another winner.
4.6. It shall be at the Promoter’s discretion whether a replacement winner is selected or not. If the replacement winner fails to answer the Promoter’s telephone call on the first attempt as required, the above provisions of this clause shall apply to thatreplacement winner in the same way as the original winner. The Promoter has the discretion to conduct an immediate redraw.
4.7. Should the winner fail to collect his/her prize, alternatively fail to take the necessary steps to take possession of his/her prize within 1 (one) week from the date of the prize draw, such prize will be forfeited. The winner shall have no claim for damages or any other claim whatsoever, arising from such forfeit against the Promoter, its directors, members, partners, employees, agents, consultants, suppliers, contractors, and sponsors.
5. General
5.1. All Participants entering this Promotional Competition agree that the promotional terms and conditions (‘Terms and Conditions’) are binding upon them.
5.2. Nothing in these Terms and Conditions is intended to or must be understood to restrict, limit, or avoid any rights and/or obligations, as the case may be, created for either the participants or the Promoter in terms of the Consumer Protection Act 68 of 2008 (‘Consumer Protection Act’).
5.3. The Participant, upon signature thereto, acknowledges that by participating in this Promotional Competition he or she has been afforded the appropriate opportunity to first read, understand, and agree to these Terms and Conditions.
5.4. The Participant in this Promotional Competition partakes entirely at their own risk. By reading and accepting these Terms and Conditions, the participant gives consent to these risks and hereby indemnifies and holds harmless the Promoter and any other persons who directly or indirectly control or are controlled by or are in common control with the Take n Pay Group; their directors, members, employees, consultants and agents of any liability pertaining to any damage, cost, injuries, and losses of whatever nature sustained as a result of their participation in this Competition, related events, and activities, save where such damage, cost, injuries, and losses are suffered as a result of the gross negligence or wilful misconduct of any indemnified party.
5.5. The Promoter, any entity in the Promoter’s Group or Company respectively, their directors, members, partners, employees, agents or consultants, the suppliers of goods or services in connection with this promotional competition, or any other person who directly or indirectly controls or is controlled by the above-named parties and their respective spouses, life partners, business partners or immediate family members are not permitted to participate in this Promotional Competition.
5.6. The Promoter would publish the names and photographs of prize qualifiers in advertising, promotional, print, marketing, and other material.
5.7. All information relating to this promotional competition and published on any promotional or advertising material forms part of these terms and conditions of entry.
5.8. In the event of a dispute, the decision of the Promoter will be final and binding on all aspects of this promotional competition and no correspondence will be entered into.
5.9. If required by the Minister for Trade and Industry, the Consumer Protection Commission, or for any other reason, the Promoters shall have the right to terminate this promotional competition immediately and without notice of such termination. In such event, all entrants hereby waive any rights, which they may have against the Promoter and hereby acknowledge that they will have no recourse or claim of any nature whatsoever against the Promoter, their directors, members, partners, employees, sponsors, agents, or consultants.
5.10. The winner is obliged to provide the Promoter or its third-party suppliers with additional information that the Promoter or its third-party suppliers may reasonably require to process and facilitate the winner’s acceptance and/or use of the Prize.
5.11. The Promoter reserves the right to amend the terms and conditions as well as terminate the promotional offer at any time. In the event of such termination, all participants agree to waive any rights that they may have in terms of the promotional offer and acknowledge that they will have no recourse against the Promoters, its advertising agencies,advisors, suppliers and nominated agents.
5.12. The Promoter reserves the right, should the need arise, to vary elements of the Promotional Competition and Prize, if deemed necessary. In such an event, the variation will be communicated to the winner.
5.13. Should the Promoter be unable, for any reason whatsoever, to supply the specified Prizes, the Promoter reserves the right to substitute the advertised prize (or any element(s) of the advertised prize) for an equivalent value prize.
5.14. If the Promoter suspects foul play by any Participant, they are entitled to disqualify the Participant with immediate effect. The Promoter’s decision regarding this matter is final and no correspondence on this matter will be entertained.
5.15. Entrants to this Promotional Competition are responsible for entering their correct personal details. The Promoter will not be held liable should the details submitted are incorrect.
5.16. Should the winner, for any reason whatsoever, including any failure and/or negligence on the part of the Promoter, their directors, members, partners, employees, agents, and/or consultants, be unable to take up the prize before the expiryof the Prize then no liability shall attach to the Promoter, their directors, members, partners, employees, agents and/or consultants.
5.17. Should any winner, fail to comply with any of the terms and conditions then:
5.17.1. The winner will automatically be disqualified, and the winner will forfeit the prize; and
5.17.2. The winner will reimburse the Promoter for any loss or damage incurred by the Promoter directly or indirectly as a result of the winner’s non-compliance, including legal costs associated with this non-compliance.
5.18. The Promoter reserves (but not limited to) the following rights:
5.18.1. The right to substitute the prize with other prizes of similar commercial value.
5.18.2. The right to alter the dates of competition commencement and the competition ‘end date’.
5.19. By entering this Promotional Competition, the Participant agrees to receive promotional information using electronic mail or short message system from the Promoter, its agents, and/or associated companies.
5.20. The Participant indemnifies the Promoter for any loss or damage, including unauthorized use or fraud, that may be suffered by the Participant.
6. Data Privacy
6.1. The entrants hereby consent to provide the Promoter with the relevant Personal Information required to enter the competition as well as allow the Promoter to share the Personal Information with the designated third parties.
6.2. All Personal Information shared within the context of the competition will be treated as confidential and shall only be processed for the sole purpose of the competition. Any other processing of any Personal Information by the designated third parties and Promoter (“all parties”) is prohibited.
6.3. It is the responsibility of the entrant to provide accurate personal information otherwise the Promoter would not be able to comply with the Data Protection and Privacy Laws of South Africa.
