TERMS AND CONDITIONS FOR THE TAKE N PAY ‘’ FUSION OF AFRICA WIN 1 OF 4 CARS”  

PROMOTIONAL COMPETITION CONDUCTED BY TAKE N PAY FOOD TOWN HYPER (“THE  

PROMOTER”) 

The Competition commences on 5TH of May 2024 and ends in October 2024 (subject to change) 

1. COMPETITION

To enter this promotional competition you must: 

1. Purchase at TAKE AND PAY FOOD TOWN HYPER for the value of R300.00 or more
2. Visit www.takenpay.co.za , click on the win Tab, complete the entry form.

To qualify as an entrant into this promotional competition you must:– 

1. Purchase at TAKE AND PAY FOOD TOWN HYPER for the value of R300.00 or more.
2. Be a resident in South Africa;
3. Be at least 18 years of age;
4. Have a valid driver’s license;
5. Enter this promotional competition in your personal capacity and not as a business. For example, a close corporation, partnership or any other legal entity cannot participate. 

Each purchase will result in an entry in the prize draw.  

2. PRIZES 

4 (Four) Entrants stand a chance of winning 1 of 4 Chery Omoda c5s  

The Final draw will be held on 15th November. (Subject to change) 

Prize winners will be notified by telephone with the details that they supplied on the entry form. 

Should the Promoter be unable to contact any of the winners and verify the winners’ identities within 1 (ONE) week of the prize draw, the Promoter reserves the right to hold another random draw and allocate the prize to another winner. 

Should the winner fail to collect his/her prize, alternatively fail to take the necessary steps to take possession of his/her prize within 1 (ONE) week from the date of the prize draw, such prize will be forfeited and the winner shall have no claim for damages or any other claim whatsoever, arising from such forfeit against the Promoter, its directors, members, partners, employees, agents, consultants, suppliers, contractors and sponsors. 

3. GENERAL 

• The Promoter of this promotional competition is TAKE N PAY FOOD TOWN HYPER (“the Promoter”).
• TAKE N PAY FOOD TOWN HYPER would publish the names and photographs of prize qualifiers in advertising, promotional, print, marketing and other materials.
• The Promoter, its directors, members, partners, employees, agents or consultants and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter this promotional competition.
• All information relating to this promotional competition and published on any promotional or advertising material forms part of these terms and conditions of entry.
• In the event of a dispute, the decision of the Promoter will be final and binding on all aspects of this promotional competition and no correspondence will be entered into.
• The Promoter, its directors, members, partners, employees, agents, consultants, suppliers, contractors, and sponsors assume no liability whatsoever for any direct or indirect loss or damage arising from an entrant’s participation in this promotional competition or for any loss or damage, howsoever arising. 
• If required by the Minister for Trade and Industry, the Consumer Protection Commission or for whatever other reason, the Promoters shall have the right to terminate this promotional competition with immediate effect and without notice of such termination. In such event, all entrants hereby waive any rights, which they may have against the Promoter and hereby acknowledge that they will have no recourse or claim of any nature whatsoever against the Promoter, their directors, members, partners, employees, sponsors, agents or consultants. 
•    TAKE N PAY FOOD TOWN HYPER will brand the vehicle won with its current marketing materials and designs. The winner is obliged to leave these brandings on the vehicle, unaltered, for a minimum period of 24 months after taking delivery of the vehicle. On occasion TAKE N PAY FOOD TOWN HYPER may request pictures of the vehicle for reference to the branding and that the vehicle be brought back for the replacement of the branding materials with new versions. The winner will be obliged to comply with this request and will not be able to sell or trade in the vehicle for this duration. Take n Pay will hold the original logbook for a period of 2 years. 
• The winner must supply the Promoter, or our third-party suppliers, with additional information that we may reasonably require in order to process and facilitate your acceptance and/or use of the prize.
• The Promoter reserve the right, should the need arise, to vary elements of the competition and prize, if deemed absolutely necessary. In such an event the variation will be communicated to the winner.
• Should the Promoter be unable, for any reason whatsoever, to supply the specified prizes, the Promoter reserves the right to substitute the advertised prize (or any element(s) of the advertised prize) for an equivalent value prize.

• If the Promoter suspects foul play by any participant they are entitled to disqualify the participant with immediate effect. The Promoter’s decision regarding this matter is final and no correspondence on this matter will be entertained.
• Entrants to the competition are responsible for entering their correct personal details and should they win, the Promoter will not be held liable should the details submitted be incorrect.
• All entrants, by entering this promotional competition, agree to be bound by these terms and conditions.
• The Prizes are not transferable. 
• The Prizes cannot be exchanged for cash or any other prize other than the prize offered above.
• Should the winner, for any reason whatsoever, including any failure/negligence on the part of the Promoter, their directors, members, partners, employees, sponsors, agents, or consultants, be unable to take up the prize before the expiry of the prize then no liability shall attach to the Promoter, their directors, members, partners, employees, sponsors, agents, or consultants.
• The winner on the main prize is required to possess a valid driver’s licence, and the main prize will only be released upon sufficient proof of a valid driver’s licence.
• The Promoter will have the main prize, as described above, registered, and licenced in the winner’s name after the winner’s identity and driver’s licence have been verified.
• The main prize as described above will be wrapped with branding, which branding the winner shall not remove for a period of TWO YEARS, from the date of taking delivery of the vehicle. Upon the expiry of the abovementioned two-year period the winner can contact the Promoter for the details of suppliers who can remove the wrapping, and the cost of such removal is to be paid by the winner of the competition. Should the winner have the wrapping removed, the Promoter will not be held liable for any costs or damages incurred by the winner.
• Should any winner, fail to comply with any of the terms and conditions then:

– The winner will automatically be disqualified and the winner will forfeit the prize; 

– The winner will reimburse the Promoter for any loss or damage incurred by the Promoter directly or indirectly as a result of the winner’s non-compliance, including legal costs associated with this non-compliance. 

• The Promoter reserves the following rights:

– The right to substitute the prize with other prizes of similar commercial value.  

– The right to alter the dates of competition commencement and the competition ‘end date’. 

• By entering this competition you agree to receive promotional information by means of electronic mail or short message system from TAKE N PAY FOOD TOWN HYPER, its agents or associated companies.
